1 Introduction 

These Terms & Conditions (“Terms”) govern your use of the websites and services operated by Todd Stuart Pty Ltd, including its associated brands Todd Stuart, Mainartery, and Sculpt Place Make (“we,” “our,” or “us”). By accessing or using our websites, products, or services, you agree to be bound by these Terms. 

2 Intellectual Property 

• All artworks, concepts, designs, text, graphics, logos, images, and other content displayed on our websites or provided in proposals and projects are the intellectual property of Todd Stuart Pty Ltd, unless otherwise stated. 
• You may not copy, reproduce, modify, distribute, or commercially exploit any of our intellectual property without prior written consent. 
• For commissioned artworks, intellectual property rights remain with Todd Stuart Pty Ltd unless a written contract explicitly transfers such rights to the client. 

3 Services & Products 

We specialise in sculpture design, fabrication, consultancy, and project management, as well as bespoke and limited-edition artworks. 

• Services are subject to a signed agreement, quotation, and approved project brief. 

• Quotations are valid only for the timeframe stated. Prices may change due to material costs, design changes, or project scope variations. 

• Limited edition works are produced in fixed quantities as specified in writing. 

4 Payments & Deposits 

• A non-refundable deposit is required to confirm any commission or project. 
• Largescale and custom works typically require milestone payments linked to project stages, as outlined in the project agreement. 
• Stock items or limited editions may require full payment before dispatch. 

• Clients are responsible for all applicable bank fees, duties, and taxes. 

5 Shipping, Delivery & Installation 

• Where agreed, we manage logistics including shipping, insurance, and customs clearance. 
• Timelines for production and delivery are estimates and may be subject to external delays. 
• Installation services will only be provided where specified in writing and require the 
• site to be prepared and compliant with safety standards. 

6 Warranties & Care 

• Sculptures are fabricated to the highest standards using durable materials such as marine-grade stainless steel or silicon bronze. 
• Care and maintenance guidelines are provided. Damage from mishandling, lack of care, or environmental factors beyond reasonable control is not covered by warranty. 
• If installation is carried out by a third party, we accept no liability for resulting damage. 

7 Client Responsibilities 

• Clients must provide accurate project information and ensure approvals and site readiness before fabrication or installation. 
• Changes requested after final design approval may result in additional costs and time extensions. 

8 Limitation of Liability 

• To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from the use of our services or artworks. 
• Our liability for any claim shall not exceed the total amount paid by the client for the specific artwork or service. 

9 Privacy & Data Use 

• Personal information provided by clients or website visitors is collected and managed in accordance with our Privacy Policy. 

10 Third-Party Links 

• Our websites may include links to external sites. We are not responsible for their content or 

policies. 

11 Governing Law 

• These Terms are governed by the laws of Victoria, Australia. Disputes shall be subject to the exclusive jurisdiction of the Victorian courts unless agreed otherwise in writing. 

12 Amendments 

• We may update these Terms at any time. The latest version will always be available on our 

websites. 

Refunds & Returns Policy 

1 Purchases from Our Range 

If you purchase an artwork from our existing range and are not completely satisfied, we offer: 

• Full Refund: Less packaging, shipping, and insurance costs. 

• Credit Option: Credit toward another artwork of your choice. 

Returned artworks must be in original condition and packaging, within 14 days of receipt. 

2. Commissioned Sculptures 

Commissioned works are created in close collaboration with you, with approvals at each design and production stage. 

• Due to their bespoke nature, commissioned sculptures are not refundable once fabrication has commenced. 

• We guarantee satisfaction by working with you until your sculpture fully reflects the agreed vision.

3. Quality & Longevity Guarantee 

Our sculptures are crafted from premium materials to last generations. Care guidelines are provided to protect your investment. 

4. Relationship & Commitment
